1. Agreement and parties
These Terms of Use ("Terms") govern your access to and use of the Standard Intelligence Platform (the "Platform") and this website, operated by Standard Intelligence Ltd, a company registered in England and Wales ("Standard Intelligence", "we", "us"). By creating an account or accessing the Platform, you agree to these Terms on behalf of yourself and, where applicable, the organisation you represent ("you", "your organisation").
If you are accepting these Terms on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not have that authority, do not accept these Terms.
2. Access and accounts
Access to the Platform is granted per tenant. The tenant administrator is responsible for managing user access within their tenant, including the assignment of roles and the revocation of access for departing users. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account. You must notify us immediately of any suspected unauthorised access at [email protected].
We reserve the right to suspend or terminate access where we reasonably believe your account has been compromised, used in violation of these Terms, or used to cause harm to other users or the Platform.
3. Subscription tiers and payment
The Platform is available on three subscription tiers: Essentials, Professional, and Enterprise. The features available at each tier are described on the Pricing page and in your subscription agreement. Subscriptions are billed annually in advance unless otherwise agreed. Upgrades take effect immediately; downgrades take effect at the next renewal date.
We do not offer refunds for unused subscription periods except where required by applicable law or where we are in material breach of these Terms. All prices are exclusive of VAT unless stated otherwise.
4. Acceptable use
You may use the Platform only for lawful purposes and in accordance with these Terms. You must not: use the Platform to create documentation that you know to be false, misleading, or intended to deceive a competent authority or notified body; attempt to circumvent the Platform's access controls, authentication, or tenant isolation; use automated tools to submit queries to the AI Regulatory Navigator at a rate that exceeds normal human usage; introduce malicious code, conduct penetration testing without prior written consent, or deliberately degrade service for other tenants; or resell or sub-license access to the Platform without our written consent.
5. Intellectual property
Standard Intelligence and its licensors retain all intellectual property rights in the Platform, including its software, design, documentation, regulatory rules engine, and the AI Regulatory Navigator's corpus and system prompts. Nothing in these Terms transfers any intellectual property rights to you.
The research publications available in the Research Library are licensed for personal and internal use. They may not be reproduced, distributed, or published externally without our prior written consent.
6. Your content
You retain ownership of all content you create or upload to the Platform — AISDP questionnaire responses, evidence attachments, risk registers, monitoring data, and approved documents ("Your Content"). You grant Standard Intelligence a limited, non-exclusive licence to host, store, and process Your Content solely for the purpose of providing the Platform to you.
You are responsible for ensuring that Your Content does not infringe third-party intellectual property rights and does not contain unlawful material. You are the data controller for any personal data contained in Your Content; Standard Intelligence acts as a data processor under the terms of our Data Processing Agreement.
7. AI features and advisory notices
The AI Regulatory Navigator provides preliminary regulatory assessments to assist your compliance team. These assessments are advisory only. They are not legal advice. They are not a substitute for independent legal or regulatory counsel. The formal risk classification recorded in your AISDP is a separate, user-driven step that requires deliberate human action.
Standard Intelligence takes reasonable steps to validate citations produced by the Navigator against the EU AI Act corpus and to suppress fabricated references. However, we do not guarantee the accuracy, completeness, or currency of Navigator outputs. The regulation and its implementing acts continue to develop; corpus updates are subject to Standard Intelligence's internal governance process and may lag published guidance. You should not rely on Navigator outputs as definitive statements of your legal position.
The Dataset Schema Analysis module uses AI to evaluate dataset columns. Outputs are intended to assist your data governance team in identifying sensitive data categories and proxy variables, not to replace a formal DPIA or the judgement of a qualified data protection professional.
8. Service levels and availability
Standard Intelligence targets 99.9% monthly uptime for the Platform, excluding scheduled maintenance. Current and historical uptime information is available on the Status page. Where we fail to meet this target in a given month, you may be eligible for a service credit under our Service Level Agreement, which forms part of the Professional and Enterprise subscription agreements.
We reserve the right to conduct scheduled maintenance with reasonable notice. We will use reasonable endeavours to schedule maintenance during low-usage periods and to provide at least 72 hours' advance notice for planned downtime.
9. Confidentiality
Each party agrees to keep the other's confidential information — including the terms of any subscription agreement, pricing not publicly disclosed, and any non-public product roadmap information — strictly confidential. This obligation survives termination for three years. Standard Intelligence will treat Your Content as confidential and will not access it except as necessary to provide the Platform, respond to a support request you have raised, or comply with a legal obligation.
10. Data protection
Our collection and processing of personal data is described in the Privacy Policy. Where you use the Platform to process personal data on behalf of individuals, you act as data controller and Standard Intelligence acts as data processor. Processing is governed by the Data Processing Agreement incorporated into your subscription agreement. By accepting these Terms, you confirm that you have a lawful basis for any personal data you submit to the Platform.
11. Limitation of liability
To the extent permitted by law, Standard Intelligence's aggregate liability to you under or in connection with these Terms is limited to the total fees paid by you in the 12 months preceding the event giving rise to the claim. Standard Intelligence is not liable for indirect, consequential, or special losses, loss of profit, loss of business, or loss of data — even if we have been advised of the possibility of such losses.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.
12. Indemnity
You agree to indemnify Standard Intelligence against any claims, losses, damages, and expenses (including reasonable legal costs) arising from: your breach of these Terms; Your Content infringing third-party rights; your use of the Platform in a manner not authorised by these Terms; or any regulatory action taken against you in connection with AI systems you have documented using the Platform.
13. Term and termination
These Terms remain in force for the duration of your subscription and for any period thereafter during which you retain access to Platform data. Either party may terminate the subscription agreement on written notice if the other party is in material breach and fails to remedy that breach within 30 days of written notice. We may terminate immediately for non-payment or serious breach of the Acceptable Use provisions.
On termination, you may export Your Content for 30 days. After that period, we will securely delete Your Content from our systems, subject to any legal retention obligations.
14. Changes to the service and these terms
We may update these Terms from time to time. We will notify tenant administrators of material changes by email at least 30 days before they take effect. Your continued use of the Platform after the effective date of any change constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you may terminate your subscription before the change takes effect.
We may modify, discontinue, or deprecate Platform features with reasonable notice. Where a deprecated feature is material to your use of the Platform, we will provide at least 90 days' notice.
15. Governing law and disputes
These Terms are governed by the laws of England and Wales. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, save that Standard Intelligence may seek injunctive relief in any jurisdiction where necessary to protect its intellectual property or confidential information.
Before initiating formal proceedings, both parties agree to attempt to resolve any dispute in good faith through direct negotiation. If the dispute is not resolved within 30 days of written notice, either party may escalate to formal proceedings.
