Providers established outside the EU who place AI systems on the EU market must appoint an authorised representative established in the EU. The representative’s responsibilities include maintaining a copy of the technical documentation, cooperating with competent authorities, and providing information to demonstrate compliance.
The authorised representative should have technical understanding sufficient to respond meaningfully to authority inquiries. A purely legal appointment, where the representative holds documentation but cannot explain technical details, may prove inadequate during an inspection. The representative should have access to technical support from the provider’s engineering team and understand the AISDP at a level sufficient to navigate routine authority interactions independently.
The representative’s written mandate must be on file and cover the AI Act scope. The mandate is referenced in the Declaration of Conformity (Annex V, point 2) and the EU database registration.
