Where conflicting member state guidance was identified and a position adopted, the position paper documents the conflict, the interpretations considered, the position chosen, the reasoning, the evidence supporting the position, and any advisory opinions sought. Position papers demonstrate good faith compliance effort.

Where a conflict is later resolved (by the AI Office, a court, or harmonised standards), the resolution assessment and any AISDP updates are appended to the position paper.
